The rule and its enforcement
Town and Country Planning (General Permitted Development) Order 2008 amendment: hard-surfaced paving exceeding 5m² in a front garden is no longer permitted development unless made of porous/permeable material OR the rainwater run-off is directed to a porous/permeable area within the property. London boroughs enforce: Camden + Islington + Hackney + Wandsworth + Lambeth + Westminster + K&C routinely issue enforcement on impermeable concrete/asphalt drives installed retrospectively. Removal costs at householder expense plus re-laying compliant surface — typical enforcement bill £6,500–£12,500 on a 25m² drive.
Compliant surface options
Permeable by default: resin-bound aggregate (any colour, 15–20-year life, £150–£220/m²); permeable block paving (Marshalls Drivesett Argent Priora, Tobermore Hydropave, Brett Omega — vertical joints with permeable grit, £110–£165/m²); permeable porcelain (specialist — £165–£245/m²); gravel + cellular reinforcement (Gravelrings + 25mm 10mm angular, £75–£125/m²); reinforced grass paving (Bodpave 85 + topsoil + seed, £85–£135/m²). Build-up critical: Type 3 open-graded sub-base (not Type 1) + permeable laying course + permeable jointing.
Impermeable surface + soakaway route
If you want impermeable natural stone, granite setts, traditional Yorkstone or concrete: install a soakaway crate sized for run-off catchment to keep PD-compliant. Soakaway design: 240L Polycrub or Aquacell crate per 10m² of impermeable surface, buried 0.8–1.2m deep, surrounded by geotextile + 200mm aggregate. Test percolation of soil first (BRE Digest 365 method) — London clay soils often fail percolation. If soil fails, soakaway not viable — must use permeable surface or apply for planning + connect to drainage. Soakaway cost £850–£1,850 supplied + dug + connected on a typical 25m² drive.
